Terms of Service

Please read these Terms of Service carefully before using the NextClean platform. By accessing or using our platform, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not use the platform.

1. ABOUT NEXTCLEAN

NextClean is a technology marketplace platform operated by Alexania Rocha, trading as NextClean (sole trader). We connect customers seeking domestic cleaning services with independent self-employed cleaners ("Cleaners").

Important: NextClean is a marketplace platform only. We do not employ Cleaners, provide cleaning services, or act as a contractor or agent for any Cleaner. All cleaning services are provided by independent self-employed third parties. NextClean's role is limited to facilitating connections, processing payments, and providing platform infrastructure.

2. ELIGIBILITY

To use the NextClean platform, you must:

  • Be at least 18 years of age
  • Be legally capable of entering into binding contracts under English law
  • Provide accurate, complete, and up-to-date information at all times
  • Not be prohibited from using the platform under any applicable law

By creating an account, you represent and warrant that you meet all of the above requirements.

3. USER ACCOUNTS

You are responsible for maintaining the confidentiality of your account login credentials and for all activity that occurs under your account. You agree to:

  • Notify us immediately of any unauthorised use of your account at info.nextclean@gmail.com
  • Not share your login credentials with any third party
  • Ensure that all information in your account remains accurate and current

NextClean reserves the right to suspend or terminate accounts where there is suspected unauthorised access, fraudulent activity, or breach of these Terms.

4. BOOKINGS

4.1 Service Model

All services on the NextClean platform are fixed-price and outcome-based. The time estimates displayed are indicative maximums only — completion is based on reasonable service standards, not time. A Cleaner may leave early if the job is completed to standard within the allotted time.

4.2 Customer Obligations

By making a booking, you agree to:

  • Provide accurate property details and booking information
  • Ensure safe, hazard-free access to the property at the scheduled time
  • Provide all necessary cleaning materials and equipment unless otherwise agreed
  • Disclose the presence of pets, known hazards, or access requirements in advance
  • Not request services outside the scope of what was booked without agreement

Failure to meet these obligations may result in the Cleaner refusing or modifying the service, with no refund entitlement.

4.3 Instant Booking

All bookings are instant — no quotes are required. By completing the checkout process, you enter into a binding agreement to purchase the selected service at the stated price.

5. PAYMENTS

  • All payments are processed securely via Stripe, our third-party payment processor
  • Full payment is taken at the time of booking
  • Prices displayed are inclusive of the platform service fee
  • By completing a booking, you authorise NextClean to charge your selected payment method for the full booking amount
  • NextClean is not responsible for any fees, charges, or currency conversion costs applied by your bank or card provider

6. CANCELLATIONS

6.1 Customer Cancellations

  • Free cancellation: Cancel more than 48 hours before the scheduled booking start time for a full refund
  • Late cancellation: Cancellations made within 48 hours of the scheduled start time may be subject to a cancellation fee of up to 50% of the booking value
  • No-show: If a customer is not present or does not grant access at the scheduled time, the full booking fee is forfeited

6.2 Cleaner Cancellations

Where a Cleaner cancels or is unable to attend, NextClean will attempt to arrange a replacement. If no replacement is available, a full refund will be issued. NextClean is not liable for any losses beyond the booking value in such circumstances.

7. SERVICE LIMITATIONS

The NextClean platform is designed for standard domestic residential cleaning only. Services are not suitable for:

  • Commercial, industrial, or business premises
  • Post-construction or builders' cleans
  • Hazardous, unsafe, or unsanitary environments
  • Properties with serious pest infestations
  • Any environment that poses a risk to the Cleaner's health or safety

Cleaners have the right to refuse service under such conditions. No refund will be withheld where a Cleaner refuses on genuine health and safety grounds.

8. COMPLETION & EVIDENCE

Cleaners are required to check in and check out via the platform for every job. Cleaners may submit photos and completion confirmations as evidence of service delivery. This evidence forms part of the platform's quality control and dispute resolution process. Customers acknowledge that this evidence may be used in the event of a dispute.

9. RATINGS & REVIEWS

Both customers and cleaners may submit ratings and reviews following a completed booking. By submitting a review, you confirm that it is honest, accurate, and based on your genuine experience. You agree not to post:

  • False, misleading, or fabricated content
  • Offensive, abusive, or defamatory material
  • Content that identifies or exposes personal information of any individual

NextClean reserves the right to remove any review that violates these standards. Submitting false reviews may result in account suspension.

10. DISPUTES & REFUNDS

10.1 Raising a Dispute

If you are dissatisfied with a completed service, you must raise a dispute via the NextClean platform within 24 hours of service completion. This window reflects the nature of domestic cleaning services — the condition of a property cannot reasonably be attributed to a Cleaner's work beyond this period, as normal household activity will alter the property's condition. This time limit exists to protect both customers and Cleaners from unfair or unverifiable claims.

Disputes raised outside this 24-hour window will not be eligible for a refund. This does not affect your statutory rights under the Consumer Rights Act 2015 or any other applicable UK law. All disputes must include supporting evidence (photographs and written description) to be considered.

10.2 Dispute Resolution Process

Upon receiving a dispute, NextClean will:

  • Acknowledge receipt promptly
  • Request evidence from both the customer and the Cleaner
  • Review all evidence against our resolution criteria
  • Issue a decision within a reasonable timeframe
  • Communicate the outcome clearly to both parties

10.3 Refund Outcomes

  • Full refund — where service was not delivered or Cleaner did not attend
  • Partial refund — where service was delivered below standard, proportional to the shortfall evidenced
  • Declined — where no supporting evidence is provided, or the dispute falls outside the eligible window

10.4 Dispute Decisions

NextClean's dispute decisions are made in good faith based on the evidence available. All decisions are subject to your statutory rights under applicable UK consumer law, including the Consumer Rights Act 2015. Nothing in these Terms limits or excludes rights that cannot be excluded by law.

11. LIABILITY

11.1 NextClean's Liability

To the maximum extent permitted by applicable law, NextClean's total liability to you in connection with the platform shall not exceed the value of the booking giving rise to the claim.

NextClean is not liable for:

  • The acts, omissions, or negligence of independent Cleaners
  • Any indirect, consequential, or special losses
  • Loss of profits, data, or business opportunity
  • Platform downtime or technical failures beyond our reasonable control

11.2 What We Do Not Exclude

Nothing in these Terms limits or excludes NextClean's liability for: death or personal injury caused by our negligence; fraud or fraudulent misrepresentation; any liability that cannot be excluded under the Consumer Rights Act 2015 or any other applicable UK law.

11.3 Cleaner Liability

Cleaners are independent self-employed contractors solely responsible for the quality of their work, their conduct, and maintaining their own public liability insurance (minimum £1,000,000 per claim). NextClean does not guarantee the standard of any individual Cleaner's work beyond facilitating the booking and providing the dispute resolution process described herein.

12. INDEMNITY

You agree to indemnify, defend, and hold harmless NextClean and its operator from and against any claims, damages, losses, costs, and expenses (including reasonable legal fees) arising from:

  • Your use of the platform in breach of these Terms
  • Your provision of false or misleading information
  • Your infringement of any third party's rights
  • Any dispute between you and another user of the platform

13. INSURANCE

All Cleaners on the NextClean platform are required to hold valid public liability insurance with a minimum cover of £1,000,000 per claim as a condition of operating on the platform. NextClean verifies insurance at the point of Cleaner onboarding. However, NextClean does not guarantee that a Cleaner's insurance will be valid at the time of any specific booking, and customers are advised to raise any concerns about property damage through our dispute process promptly.

14. OFF-PLATFORM TRANSACTIONS

Users are strictly prohibited from arranging cleaning services directly with a Cleaner they have met through the NextClean platform, outside of the platform, to circumvent the platform fee. This prohibition applies during any active engagement and for a period of 12 months following the last booking. Breach of this clause may result in immediate account suspension and a claim for liquidated damages equivalent to the platform commission on the estimated value of diverted work.

15. PROHIBITED CONDUCT

You agree not to:

  • Use the platform for any unlawful purpose
  • Provide false, inaccurate, or misleading information
  • Harass, abuse, or threaten any other user or NextClean staff
  • Attempt to gain unauthorised access to any part of the platform
  • Introduce malware, viruses, or harmful code to the platform
  • Scrape, copy, or reproduce platform content without written permission
  • Circumvent the platform to conduct off-platform transactions (see Clause 14)

16. TERMINATION

NextClean reserves the right to suspend or permanently terminate your account, without prior notice, where:

  • You have materially breached these Terms
  • Fraudulent, abusive, or unlawful activity is suspected or detected
  • Your conduct poses a risk to other users or the integrity of the platform

Where possible and where it does not compromise an investigation, we will notify you of the reason for suspension or termination. Upon termination, your right to use the platform ceases immediately. Any outstanding payments owed to you will be processed in accordance with our payment terms, subject to any deductions for losses caused by your breach.

17. INTELLECTUAL PROPERTY

All content, branding, software, systems, and materials on the NextClean platform — including the NC logo, platform design, and all written content — are owned by or licensed to NextClean. You may not copy, reproduce, distribute, or exploit any platform content without our prior written consent. All photographs and evidence submitted via the platform by Cleaners are licensed to NextClean for the purposes of dispute resolution, quality assurance, and platform operation.

18. PRIVACY & DATA

Your use of the platform is subject to our Privacy Policy, which is incorporated into these Terms by reference. By using the platform, you confirm that you have read and understood our Privacy Policy (available at next-clean.co.uk/privacy).

19. MODIFICATIONS TO THESE TERMS

NextClean may update these Terms at any time. Changes will be posted on this page with an updated effective date. Your continued use of the platform following any changes constitutes your acceptance of the revised Terms. We recommend checking this page periodically to stay informed of any updates.

20. GOVERNING LAW & JURISDICTION

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales, except where you are a consumer and applicable law permits you to bring proceedings in your local jurisdiction.

21. SEVERABILITY

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be deemed severable and shall not affect the validity or enforceability of the remaining provisions.

22. ENTIRE AGREEMENT

These Terms, together with our Privacy Policy and (for Cleaners) the Subcontractor Agreement, constitute the entire agreement between you and NextClean in relation to your use of the platform and supersede all prior agreements, representations, and understandings.
